Article 1 - Purpose

The purpose of these general terms and conditions of sale is to define, exclusively with regard to the relationships they establish on the Internet network, the rights and obligations of the parties arising from the online sale of products offered on the site.

These terms and conditions apply to online sales within the European territory, to the exclusion of any other document, whether the buyer is a professional or a consumer.

Purchasing a good or service through this site implies the buyer's unreserved acceptance of these terms and conditions of sale.

Article 2 – Products/Prices

1)    Products: the products offered for sale by the seller are those that appear on the site, on the day of consultation by the user, within the limits of available stocks.

Each product is accompanied by a description provided by the supplier.

The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect likeness to the product offered, particularly with regard to colours.  These products and services are offered subject to availability.  If, despite its efforts, all or part of the items are unavailable, the seller informs the buyer by email as soon as possible and offers the buyer the option of waiting or cancelling the order for the unavailable items free of charge.  The available items will be delivered as usual.

2)    Prices: Prices are shown in Euros and are valid in all countries of the Eurozone. They include any applicable discounts and VAT, as of the date of the order. The prices applicable to the order are those in effect at the time of confirmation of the order.

         Article 3 – Order Registration and Validation

                The buyer, who wishes to purchase a product or service, must:

-          fill out the identification form on which he will indicate all the requested details or give his customer number if he has one;

-          fill out the online order form providing all the references for the products or services chosen;

-          confirm your order after checking it;

-          make the payment under the conditions stipulated;

-          confirm your order and payment.

Order confirmation implies acceptance of these terms and conditions of sale, acknowledgment of having read and understood them, and a waiver of any right to invoke one's own terms of purchase or other conditions.

All data provided and the recorded confirmation will serve as proof of the transaction.  Confirmation will constitute signature and acceptance of the transactions carried out.

The seller will send an email confirming the order has been registered.

Article 4 – Delivery

For all available items, the delivery time is 2 calendar days (working days) from the day after the order is validated by the buyer.

The products ordered by the buyer will be delivered to the address indicated on the buyer's order form, which can only be within the agreed geographical area.  The goods are transported at the seller's risk until delivery of the goods to the delivery address specified by the buyer.  From that moment on, the buyer assumes all risks alone.  Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer refunded.

Article 5 – Right of withdrawal

The consumer has fourteen calendar days to notify their intention to return the undamaged product(s) they ordered, at their own expense, without penalty and without giving a reason. This period begins the day after the order is delivered. They then have 14 days to return the item(s) from the date of their notification. For goods delivered in installments, the withdrawal period begins the day after each item is delivered.

This right of withdrawal does not apply to professional buyers.

If the aforementioned conditions are met, the buyer will be reimbursed, within fourteen calendar days of the withdrawal, for any sums he or she has paid.

The buyer does not have a right of withdrawal for contracts for the supply of goods made to the buyer's specifications or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, nor in the case of the supply of audio or video recordings or computer software unsealed by the buyer, nor in the case of the supply of newspapers, periodicals and magazines.

Article 6 – Payment

All orders involve a contribution to the shipping costs referred to in art. 2. Only online payment is accepted as a method of payment.

When validating the order, the buyer is asked to indicate their VISA or MASTERCARD or maestro credit card number and expiry date on the order form: payment then takes place according to the terms agreed with their bank.

The ordered items remain our exclusive property until full payment of the order by the buyer.

Article 7 – Warranty

The buyer must keep the delivery slip. If an item is unsuitable, the buyer has 14 days to return the goods, provided they are in the same condition as when they were sent. The buyer benefits from the legal guarantee for any lack of conformity existing at the time of delivery of the item, if they were unaware of it or could not reasonably have been expected to know of the defect at the time of entering into the contract, and if it appears within two years of delivery. In this case, the buyer may demand either the repair or replacement of the item, and if neither of these solutions is possible, either an appropriate price reduction or the termination of the contract, under the conditions stipulated by law (Articles 1649 bis et seq. of the Civil Code). To do so, the buyer must notify the seller in writing no later than two months from the date on which the defect was discovered. If the defect appears within six months of delivery, it is generally the seller's responsibility to prove that it did not exist at the time of delivery. After the two-year period, the buyer can no longer demand repair or replacement of their item.

Art. 8 – Protection of privacy with regard to the processing of personal data.

Providing the personal information collected during the online sales process is mandatory, as this information is necessary for processing and delivering orders, as well as for issuing invoices. This information is strictly confidential. Failure to provide this information will result in the automatic rejection of the order. The buyer may access this data at any time and request its correction by sending a letter or email accompanied by a double-sided photocopy of their identity card. Further information regarding the protection of privacy with regard to the processing of personal data can be obtained from the Data Protection Authority, 35 rue de la Presse. at 1000 Brussels.

Article 9 – Intellectual Property

All elements of the seller's website are and remain the exclusive intellectual property of the seller.

No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the site, whether software, visual, or audio.

Any simple or hypertext link is strictly prohibited without the express prior written consent of the seller.

Article 10 - Miscellaneous

1)       Force Majeure: The seller shall not be liable for the total or partial non-performance of its obligations under this contract if such non-performance is caused by an event constituting force majeure, including the presence of computer viruses, disruption or total or partial strikes affecting postal services and means of transport and/or communications, floods, fires, etc.

Events meeting the criteria established by case law will be considered as cases of force majeure.

2)       Partial invalidity: If one or more clauses of these general terms and conditions of sale are     held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, all other clauses shall remain valid.

3)       Entire Agreement: These general terms and conditions of sale and the order summary sent to the buyer form a single contractual agreement and constitute the entirety of the contractual relationship between the parties. In the event of any conflict between these documents, the general terms and conditions of sale shall prevail.

4)       Applicable Law – Jurisdiction: These general terms and conditions of sale and the contractual relationship between the seller and the buyer are governed by Belgian law. In the event of a dispute, only the courts of the judicial district where the seller's registered office is located shall have jurisdiction, unless otherwise required by mandatory public policy provisions.
